The Draft Law on the Regulator to Be Finalized by the Line Committee

On January, 27, after its consideration by the Verkhovna Rada, MPs voted for the repeated first reading of the Draft Law “On the National Energy and Utilities Regulatory Commission”. The document will be sent back to the Committee where the MPs had to finalize and put it up for discussion in a month.

To be passed in the first reading, the document did not receive enough votes from MPs. Petro Poroshenko’s Block, the Narodnyi Front, about a half of the Samopomich and some non-affiliated MPs voted for the adoption of the Draft Law. The Batkivschyna abstained. The rest of factions and groups did not support the document.

However, this decision on the Draft Law broke a six-month pause in its consideration by the Parliament. Now it is important for all amendments to the document to be introduced as quickly as possible and receive the maximum support of MPs during the next hearing.

“I hope that in the course of finalization the MPs will take into account the proposals developed by the Strategic Advisory Group. I would like to mention that a delay of the reform will only prejudice the interests of consumers and other market players. Without the Law passed, the Regulator remains dependent on politicians and tycoons”, noted Roman Nitsovych, Program Manager, DiXi Group Analytical Centre.

It should be mentioned that at the beginning of September, the Strategic Advisory Group was announced to be established with involvement of top-notch Ukrainian and international experts and MPs. The Group is finalizing the Draft Law No. 2966 “On the National Energy and Utilities Regulatory Commission”.

While working in the Group, the experts analysed over 190 comments to the Draft Law. The activities of the Strategic Advisory Group were made possible with the support of the “Promotion of Establishment of the Independent Regulator in Ukraine” project, jointly implemented by DiXi Group and the International Renaissance Foundation.

It should be reminded that the final version of the Draft Law No. 2966 was reviewed and approved by the Energy Community Secretariat.
